Heir Tight Wills & Estate Planning specialise in providing solutions to clients with more complex situations. The nature of our clients’ requirements means they often have a need for solutions we don’t provide ourselves.

Rather than expecting you to spend your valuable time trying to find the services or support you need in other areas of your estate planning, we prefer to act as a ‘facilitator’ to other specialists, to provide a one-stop-shop for your personal and business estate and succession planning requirements.

As a result, we work in partnership with a lot of other businesses that we have tried and tested over many years and consider to be among the very best in their industry.

In addition to our Probate specialists, and contentious Will, Trust and inheritance dispute specialists, we also have partnerships with:

To advise in such areas as; pensions, income protection, life insurance, shareholder protection, investing in IHT exempt assets, and lifetime gifting.

To advise on relevant business structures and pre-disposal IHT planning for businesses, restructuring of company trading and investment assets, converting directors’ loans to share capital, tax efficient ways of getting money out of your business and advising on advanced Inheritance Tax mitigation including Family Investment companies and/or sub-fund Trusts.

For example to transfer business properties into the hands of family members during your lifetime.

To assist with the selling of Probate properties through action or to assist in the selling of investment properties (where they are structured to deal with both the vendor and the purchaser for speed and simplicity).

To advise in all manner of property disputes including:

  • boundary, trespass, party wall, right to light, right of way, subsidence and nuisance disputes
  • landlord and tenant disputes
  • commercial landlord and tenant/lease disputes
  • freehold land contractual issues
  • statutory claims
  • Trusts of and equitable interests in land
  • professional negligence

Providing assistance in dealing with or winding up existing lifetime or Will Trusts, the drafting and registration of lifetime Trusts (e.g. to transfer business shares to provide income to non-management beneficiaries), and the creation and registration of Charitable Trusts to provide for the charitable purposes you wish to support, both during your lifetime and after your death.

Helping homeowners over 55 to improve their later life finances by unlocking equity in your home; possibly to pay off your mortgage, buy a new kitchen or your dream retirement holiday, give your family financial support, or to gift family members a lump sum during your lifetime to reduce your inheritance tax liability.

For example to advise on and draft pre-nuptial agreements with the aim of protecting the assets you owned before you were married from a future potential divorce, or the drafting of a ‘Co-habitation Agreement’ for your child (e.g. to protect the investment you contributed to their home should their new partner move in).

For Attorneys appointed under a property and finance Lasting Power of Attorney (P&A LPA) to be able to make decisions on behalf of a donor, it is essential that they have a full understanding of the financial assets and liabilities of that person.

Through our professional partners we can now provide a ‘Financial Profile Search’ for the Attorneys once the Office of the Public Gurdian (OPG) has registered the LPA.

If you are the person making the P&A LPA and have lost track of some of the financial assets you have acquired over multiple decades, we can conduct the search for you while you still have mental capacity, to help you and your Attorneys manage those financial affairs.

The search makes enquiries of 450+ databases from over 200 financial institutions, and where relevant includes AML (anti-money laundering) and identity tracing, Liability Searches, Financial Asset Searches, and Company Directorships.

This service helps Executors of a Will where there is a property in the deceased’s estate.

Our partners provide specialist and cost-effective solutions for matters such as HMRC Compliant Valuation Reports for IHT (inheritance tax) purposes, streamlined property sales that guarantee higher prices, and vacant property insurance that keeps you in control. Helping to make the process as stress-free as possible for everyone involved.

If you’ve been appointed as an Executor under a Will you need to ensure that all potential beneficiaries have been traced and that you distribute the estate correctly. You will be held financially liable for any mistakes you make!

This can be particularly challenging when the estate is left to a class of beneficiaries e.g. ‘my children’, if you are dealing with an estate where there is no Will or where there are no surviving beneficiaries of a Will and the Rules of Intestacy will apply.

Through our partners we can provide ‘Family Tree Check and Verification’ services, to eliminate the risk of relying on family testimony. The service checks all available records of family documents, to rule out the possibility of missing heirs and beneficiaries.

We used Rachael to write our Wills and Powers of Attorney, relating to our personal and business assets. Rachael’s attention to detail was astounding, she took into account things which would never have occurred to us. We are very confident that everything we need is now in place, giving us a sense of security and peace of mind.
