With 1 in 3 people relying on an inheritance, and 1 in 4 willing to raise a claim if a loved one’s estate distribution is not as had been expected, disputes over inheritance arrangements often occur.
Cases are rising of people being unduly influenced to make Will provisions they wouldn’t normally make, or didn’t have the mental capacity to make.
Sadly, professional negligence claims are also rising, where unqualified or simply careless providers have advised the wrong solutions or made major drafting errors affecting the estate distribution.
With emotions running high following the death of a loved one, people are grieving and can be angry about a situation they feel is unfair. This can make disputes especially challenging to resolve, and a very difficult time for families.
If you haven’t received the inheritance you expected, or it appears that a Will is ‘just not right’, we can help.

What types of disputes can be pursued?
There are a number of reasons for validly challenging a Will or contesting Probate, and Heir Tight Wills work in partnership with specialist teams of Contentious Trust and Probate solicitors and Inheritance Dispute specialists who are able to assist with any contentious issue arising out of someone’s estate. Our partners support with making or defending such claims and also with non-probate property disputes.
Some of the contentious issues that may arise on someone’s death include
- Issues over the validity of the deceased’s Last Will, e.g. fraud, capacity, undue influence or witnessing issues
- Problems with the preparation of the deceased’s Last Will, e.g. professional negligence claims
- Claims for reasonable financial provision from the deceased’s estate
- Claims that the deceased has broken their inheritance promise to a beneficiary
- Concerns over the behaviour of an Executor, beneficiary of the estate or the Trustee of a Trust
- Concerns that assets have not passed into the estate or to the rightful recipient
- Issues relating to the ownership or vacant possession of the deceased’s property
- And even ashes or burial disputes!
There can often be tight time-limits in play for making contentious probate claims and individuals should seek urgent legal advice as soon as possible. The solicitors we work with are more than happy to speak to anyone about the situation that they are facing on an initial free consultation basis.
